We’re often asked what we as lawyers do at CastleGate Animal Law Clinic.
First and foremost, as our logo says, we’re on their side, meaning the animals’. Our prime focus is on animal welfare, respect for animals, and giving animals a voice. We strongly advocate against all practices — whether they be farming or breeding practices, entertainment or sport — where animals are harmed or at risk of harm, or being exploited.
This means we engage with the legislature to make submissions for changes to our civil laws where we believe these laws do not protect animals or promote their health and well-being (as unfortunately is often the case). This is a long and often disheartening process, but we have been doing it for decades now, and are confident that one day the many voices that have joined ours will be heard.
We have found we can promote animal welfare and give animals a voice in more immediate circumstances. For example, a vast section of our practice is devoted to regulated dog matters (menacing, dangerous or restricted). We provide expert legal advice to dog “owners” Australia-wide on these matters. We also assist with:
- applications to Councils for review of or objection to declarations or proposed declarations;
- represent dog “owners” in external review applications;
- Opposing ‘destruction’ orders;
Where we think there has been an injustice to the relevant dog or a risk to the relevant dog’s welfare, we will act pro bono.
We can also assist with preparing responsible and effective breeder’s contracts, incorporating the care of pets in estate planning and in family law matters, and represent “owners” in negligence claims.
